Terms of Service

Effective: Pending counsel review

1. Acceptance

By placing an order with Delivered Fireworks (“Delivered,” “we,” “us”), you agree to these Terms. If you do not agree, do not place an order.

2. Eligibility & age verification

You must be 21 years of age or older to purchase consumer fireworks from Delivered. We require an age attestation at checkout and a physical ID check at delivery. Misrepresentation of age voids the order and may be a violation of state and federal law.

3. Geographic restrictions

Delivered ships only to addresses inside our published delivery zones. We will not transport fireworks by ferry. For ferry-access destinations (Put-in-Bay, Kelleys Island, South Bass Island), delivery is to a designated mainland meeting point.

4. Local laws

Customer is solely responsible for confirming that the product, the purchase, and the discharge are legal at the customer’s address and city. We do not warrant that any product is legal everywhere in the destination state.

5. Payment

Payment is due in full at checkout.

6. Sky Club rewards

Sky Club members earn a $50 credit for every $1,000 of eligible spend. Eligible spend is the product subtotal you actually pay by card, after discounts, and excludes the processing & delivery fee, tax, gift card purchases, and any portion paid with reward credit or a gift card. Credit is issued as a gift card code once payment is confirmed, never expires, and applies to the product subtotal of future orders. Refunds reduce eligible spend and may void an unused credit. We may correct or reverse credit issued in error.

7. Product representations

All product images and videos on this site are example representations of the product type and may not be the exact item you receive. Selection varies by availability. We will substitute items of equal or greater value when stock requires.

8. Limitation of liability

Consumer fireworks are inherently dangerous. Delivered is not liable for injury, property damage, or fire caused by improper handling, discharge in violation of local law, or use by anyone other than the purchaser. The full liability framework will be finalized by counsel and will include a binding arbitration clause and a Class Action waiver.

9. Changes

We may update these Terms at any time. Continued use of the site or placement of a new order after an update constitutes acceptance of the revised Terms.
